1. Service Description

Aspectr is a software-as-a-service (SaaS) platform that provides automated image and video resizing for advertising campaigns. Our service allows you to:

• Upload images and videos
• Automatically resize and crop content to multiple advertising platform specifications
• Download optimized assets for use in your campaigns

2. Account Registration

2.1 To use Aspectr, you must create an account with a valid email address.

2.2 You are responsible for maintaining the confidentiality of your account credentials.

2.3 You must be at least 18 years old to use this service.

2.4 Business accounts must be registered by an authorized representative.

3. Subscription Plans & Billing

3.1 Plans and Pricing

We offer the following subscription tiers:

• Trial: Limited free access (100 images, 10 video minutes, 7 days)
• Solo: €79/month (billed annually) or €89/month (billed monthly)
• Pro: €249/month (billed annually) or €279/month (billed monthly)
• Agency: €649/month (billed annually) or €729/month (billed monthly)

3.2 Billing

• Annual subscriptions are billed upfront for the full year
• Monthly subscriptions are billed at the start of each billing cycle
• All prices are in Euros (€) and exclude applicable taxes

3.3 Quota Limits

Each plan includes monthly limits for image outputs, video minutes, storage (GB), and maximum file size per upload. Exceeding these limits will require an upgrade to continue processing.

3.4 Renewals

Subscriptions automatically renew unless cancelled before the renewal date.

4. Cancellation & Refunds

4.1 Cancellation

You may cancel your subscription at any time through your Account Settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until that date.

4.2 14-Day Money-Back Guarantee

We offer a 14-day money-back guarantee on your first paid subscription. If you're not satisfied with Aspectr for any reason, contact us within 14 days of your first payment and we'll issue a full refund.

Conditions:

• Applies to your first payment only (not renewals or subsequent subscriptions)
• Request must be made within 14 days of the initial charge
• Contact support@aspectr.app to request a refund

4.3 After 14 Days

After the 14-day guarantee period:

• All subscription fees are non-refundable
• You may cancel your subscription at any time
• Canceled subscriptions remain active until the end of your current billing period
• No partial refunds are provided for unused time

4.4 Account Deletion

If you choose to delete your account:

• Your subscription will be cancelled immediately
• Access to the service is terminated immediately
• No refund is provided for remaining subscription time
• This action is permanent and cannot be undone

4.5 Account Termination by Us

We reserve the right to terminate accounts that violate these Terms, with or without notice. In such cases, no refund will be provided.

5. Acceptable Use

You agree NOT to use Aspectr to:

5.1 Upload, process, or distribute content that:

• Infringes on intellectual property rights
• Contains illegal material
• Depicts child exploitation or abuse
• Promotes violence, hatred, or discrimination
• Contains malware or harmful code

5.2 Attempt to:

• Reverse engineer or decompile our software
• Bypass usage limits or security measures
• Resell or redistribute our service without authorization
• Use automated systems to abuse our infrastructure

5.3 Misrepresent your identity or affiliation

6. Intellectual Property

6.1 Your Content

You retain all rights to content you upload. By using Aspectr, you grant us a limited license to process your content solely for the purpose of providing our service.

6.2 Our Service

Aspectr, including its design, features, and technology, is owned by Creative Data Engineers LLC and protected by intellectual property laws.

6.3 Output Files

Resized and processed files are your property. We claim no ownership over your outputs.

7. Data Handling

7.1 Image Processing

• Images are processed entirely in your browser
• Image files are never uploaded to our servers
• We do not have access to your images

7.2 Video Processing

• Videos are sent to our processing partner (Transloadit) for resizing
• Files are automatically deleted within approximately 24 hours
• We do not retain copies of your videos

7.3 Privacy

Your use of Aspectr is also governed by our Privacy Policy.

8. Service Availability

8.1 We strive for high uptime but do not guarantee uninterrupted service.

8.2 We may perform maintenance that temporarily affects availability.

8.3 We reserve the right to modify or discontinue features with reasonable notice.

9. Limitation of Liability

9.1 Aspectr is provided "as is" without warranties of any kind.

9.2 We are not liable for:

• Loss of data or content
• Indirect, incidental, or consequential damages
• Business interruption or lost profits
• Third-party claims

9.3 Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Creative Data Engineers LLC from any claims, damages, or expenses arising from:

• Your use of the service
• Your violation of these Terms
• Your violation of any third-party rights

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by the laws of the State of New Mexico, United States. Any disputes shall be resolved in the courts of Bernalillo County, New Mexico.
